Troy Seeking Right of Way on East Side of Rochester Road
The City of Troy is widening Rochester Road, north of Long Lake. I am already representing a property owner impacted by this project. Now, Troy is seeking right of way from property owners on the west side of the road by issuing good faith offers.
The good faith offers provide only nominal compensation for pushing the public right of way closer to homes and removing trees. As such, it is a double whammy for those owners, who will have the road closer to their homes while losing the vegetation buffering them from that impact. The loss of vegetation reduces the curb appeal of properties and has other tangible impacts like increased noise and lost shade.
I have handled many road projects of this nature and obtained additional just compensation for impacted homeowners. I represent clients on a contingency basis, charging 1/3 of the increased compensation. While past results are not a promise of future performance, agencies often reimburse the contingent attorney fee as well as the costs of obtaining an independent appraisal evaluating the impact of the taking.
