ET Rover landmen are trying to acquire property rights after the pipeline was rerouted.
Here is some general advice to property owners confronted by a request for an easement.
- The pipeline company must pay owners' reasonable attorney fees based upon the industry standard contingent fee (that I also charge) and appraisal expenses.
- Property must be valued based on its highest and best use, not the actual use.
- Pipeline companies frequently ask owners to grant extremely broad easements that can be challenged or negotiated.
- Just compensation is based on the assumption that the pipeline company will use all of the rights obtained to the fullest extent allowed by law.
- The pipeline company must pay just compensation for both the property encumbered by an easement and any damage to the remaining property.
- Just compensation issues are highly complex and should only be evaluated by attorneys and appraisers who are experts in the area.
